Little Sandtopia Participation Waiver and Release of Liability

IMPORTANT: THIS IS A LEGALLY BINDING DOCUMENT. PLEASE READ CAREFULLY BEFORE SIGNING.

By signing this agreement, you are waiving certain legal rights and accepting responsibility for yourself and any participating minors under your care while at Little Sandtopia, a children’s indoor play center located in the State of Georgia.

1. Acknowledgment of Risk

I, the undersigned, on behalf of myself and any listed minor child(ren) (“Participants”), voluntarily acknowledge and assume the known and unknown risks associated with indoor play activities at Little Sandtopia. These include, but are not limited to:

• - Falls or collisions with equipment or other participants

• - Tripping, slipping, or contact with hard surfaces

• - Equipment malfunction or failure

• - Physical injury such as sprains, breaks, strains, head injuries, or paralysis

• - Emotional distress due to dynamic and crowded environments

• - Potential exposure to contagious illnesses

I understand that these risks are inherent in recreational activities and cannot be entirely eliminated without compromising the experience.

2. Waiver and Release of Liability

In consideration for being permitted to enter and use the facilities at Little Sandtopia, I hereby voluntarily release and discharge Little Sandtopia, its owners, managers, employees, agents, insurers, contractors, vendors, and affiliates (“Releasees”) from any and all claims, demands, or causes of action for any injury, illness, death, loss, or property damage resulting from:

• - Participation in Little Sandtopia activities

• - The negligence or alleged negligence of any Releasee

• - The actions or negligence of other participants or guests

• - Any condition or defect of the premises or equipment

This waiver extends to known and unknown claims and applies to all future visits unless revoked in writing.

3. Assumption of Responsibility and Fitness Certification

I certify that:

• - I and any minors listed are physically, mentally, and emotionally fit to safely participate in activities at Little Sandtopia.

• - No Participant is under the influence of alcohol, illegal substances, or impairing medications.

• - I take full responsibility for assessing fitness and risk tolerance.

• - I understand that Little Sandtopia staff are not medical professionals and do not evaluate medical risks.

4. Supervision and Conduct

• - I understand that adult supervision is required at all times.

• - I accept full responsibility for any injury or harm caused by my own or my child’s actions.

• - I will ensure that all Participants follow posted rules and the instructions of Little Sandtopia staff.

• - I agree not to bring alcoholic beverages into the facility.

5. Indemnification

I agree to defend, indemnify, and hold harmless the Releasees from any claim, liability, damage, or cost (including attorney’s fees) arising from:

• - My or my minor child’s presence or participation at Little Sandtopia

• - Any claims made by third parties due to our actions

• - Any misrepresentation of my authority to sign this waiver

6. Medical Authorization and Expenses

I understand that I am solely responsible for any medical expenses incurred due to injury or illness during our visit. In the event of an emergency, I authorize Little Sandtopia staff to seek first aid or emergency medical treatment on behalf of myself or my minor child(ren).

I acknowledge that I have disclosed any relevant allergies, medical conditions, or special needs to Little Sandtopia staff prior to participating.

7. Photo/Video Consent

By entering Little Sandtopia, I grant permission for myself and any participating minor(s) to be photographed or recorded for use in promotional materials including social media, advertisements, and digital or print media.

8. Dispute Resolution and Governing Law

Any disputes or claims arising from participation at Little Sandtopia shall be resolved first through good-faith mediation, and if unresolved, by binding arbitration in accordance with the laws of Georgia. Any legal proceeding must take place in Fulton County, GA, and must be initiated within one (1) year of the event giving rise to the claim.

9. Severability

If any part of this agreement is deemed unenforceable, the remaining sections shall remain in effect. This document represents the full understanding between the parties.

10. Certification and Parental Responsibility

I certify that I am the parent or legal guardian of the listed minor(s) and have full authority to execute this agreement on their behalf. I understand and accept full responsibility for the conduct of my child(ren) and any damage they may cause to Little Sandtopia’s property or equipment.
